TERMS AND CONDITIONS

In the following terms & conditions, “the Photographer” shall mean CHARLIE WRIGHT. “The Clients” shall be those persons defined on quotations and/or invoices as the client.
These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing.
1. COPYRIGHT AND OWNERSHIP
i. In accordance with the Copyright, Designs and Patents Act 1988, the copyright of all images created during any assignment remains the property of the Photographer at all times.
ii. Digital files remain the property of the Photographer. Original unedited (RAW) files will not be shared unless expressly agreed in writing. The Client agrees not to edit, filter, or alter any imagery provided without prior permission.
iii. The Photographer will store digital files safely for the Client and make them available for future reproduction/licensing for a relevant fee. The Photographer is not liable for files lost or destroyed due to circumstances beyond their control.
iv. The Photographer reserves the right to use any images for marketing, promotional, competition, and editorial purposes (e.g., website, social media, brochures) unless otherwise agreed.
2. LICENSING & USAGE RIGHTS
i. Upon full payment, the Photographer grants the Client (the Artist/Band) a non-exclusive, perpetual license to use the images for all standard promotional purposes. This includes social media, press kits, website use, and tour promotion.
ii. While promotional use is included in the session fee, use of images for; 1. physical merchandise for sale (e.g., T-shirts, Vinyl, Posters), 2. paid advertising (e.g., Meta/Google Ads) or 3. music artwork* (e.g., Single, Album, EP) is subject to a separate commercial agreement or a one-time buyout fee.
iii. This license is granted strictly to the Client. The Client is prohibited from transferring, sub-licensing, or "gifting" high-resolution files to third parties, including venues, promoters, gear sponsors, or brands, for their independent marketing use.
iv. Any third party wishing to use the images for their own commercial or promotional purposes must contact the Photographer directly to arrange a separate license and settle the relevant fee.
v. The Photographer must be credited (@photos.bycharlie / Charlie Wright) in all instances of use unless a "no-attribution" agreement has been reached.
vi. Use of images by any party outside the scope of this agreement or before full payment will be considered a breach of copyright and may result in an invoice for unauthorised usage.
vii. For more information about additional, commercial or third-party licenses, please reach out to Charlie directly, who will provide pricing, terms and options on request.
*If the Client’s photoshoot was commissioned for this purpose, point #3 does not apply.
3. PERFORMANCE & COVERAGE
i. The Photographer shall be granted creative license regarding shots taken and editing style. Every effort will be made to comply with special requests, but they do not constitute a binding guarantee of a specific image.
ii. The Photographer is not responsible for obstructed views or restricted coverage caused by venue formalities, lighting conditions, or sensor limitations.
iii. While equipment is regularly maintained, the Photographer is not liable for images not produced due to total technical failure. In such cases, liability is limited to a refund of fees paid.
4. ON THE DAY
i. The Photographer will attend locations at the times specified. Any coverage requested beyond the confirmed booking time is at the Photographer's discretion and may incur additional fees.
ii. For events exceeding 7 hours, a meal must be provided for the Photographer by the Client.
iii. Any directions issued by the Photographer are at the Client/guest's own risk. The Photographer is not responsible for personal accidents occurring during a shoot.
5. PAYMENT, CANCELLATION & DELIVERY
i. Payment is due in full before the delivery of goods/files.
ii. Overdue balances will accrue a charge of 5% of the total owed per week until settled.
iii. Cancellation more than two weeks before the event incurs a £20.00 fee. Cancellation less than two weeks before the event incurs full payment.
iv. If the Photographer cannot attend due to circumstances beyond their control (illness, injury, etc.), they will endeavour to find a replacement. If unsuccessful, liability is limited to a full refund.
v. Delivery timelines will be agreed upon booking sign-off.
